Background
The British Horseracing Authority (“BHA”) is the governing and regulatory body for British horseracing, which seeks to ensure the effective regulation, integrity and success of the sport. Except in commercial areas, the BHA's role is to act for and on behalf of the whole sport, ensuring that the highest standards apply on and away from the racecourse. It aims to be a global leader in racing regulation and works with stakeholders to promote the sport in order to make Great Britain the home of the most compelling racing in the world.
The BHA is a company limited by guarantee by member bodies representing stakeholders from across the sport of horseracing (“Members”). The Members are:
• the Racecourse Association Limited;
• the Racehorse Owners Association Limited;
• the Thoroughbred Breeders’ Association; and
• the National Trainers Federation as the representative of the Licensed Personnel (being the NTF, the Professional Jockeys Association and the National Association of Racing Staff).
The Integrity and Regulation Committee – Rules Section considers additions, changes and amendments to the Rules of Racing, the Regulations for Point to Point Steeple Chases and the Regulations for Arabian Horse Racing and to make recommendations ahead of their consideration by the BHA Board.
The purpose of the Rules Section is:
• To consider and agree, alter or reject modifications to the Rules of Racing proposed by the Executive;
• To propose to the Board modifications to the Rules of Racing;
• To monitor the appropriateness and effectiveness of penalties for breaches of the Rules; and
• To make recommendations to the Board regarding penalty guidance contained in the Rules of Racing.
The Rules Section of the Integrity and Regulation Committee currently comprises: the Chief Regulatory Officer of the BHA and the Director of Integrity and Regulation on an ex officio basis; the two Independent Regulatory Non- Executive Directors of the BHA Board and an external lawyer. The Committee is looking to appoint an additional member from a racing/ regulatory background.
Requirements
The successful candidate will have:
• An in-depth knowledge and appreciation of horseracing;
• Extensive experience of raceday or other sports regulation;
• Ability to consider potential implications of proposed regulatory changes;
• Outstanding communication skills and experience of contributing in a similar environment. Key responsibilities
• Attend all meetings called during the year unless prevented by exceptional circumstances;
• Attend any additional meetings as and when required;
• Respond to matters raised by email between meetings in a timely manner;
• Play an effective part in meetings, discussions and decisions;
• Adhere to high levels of personal integrity;
• Ability to innovate within sports governance.
Independence
The successful candidate must have a strong sense of conviction and be independent in both character and judgment. The Integrity and Regulation Committee Chair will determine whether there are relationships or circumstances which are likely to affect, or could appear to affect, a member’s judgment.
Whilst the independence of each candidate will be determined based on individual circumstances, the Integrity and Regulation Committee Chair may consider the following factors to be relevant to its determination of independence:
1. is or has been an employee of the BHA, GBR, and/ or a BHA Member within the last two years;
2. is or has been a Licence holder within the last two years;
3. has, or has had within the last two years, a material relationship with the BHA, GBR, and/ or a BHA Member either directly, or as a partner, shareholder, director or senior employee of a body that has such a relationship with the BHA, GBR and/ or a BHA Member;
4. receives additional remuneration from the BHA;
5. is an immediate family member of any of the advisers, directors or senior employees of the BHA, GBR, and/ or a BHA Member;
6. holds cross-directorships or has significant links with other directors on the BHA Board through involvement in other companies or bodies; or
7. represents a BHA Member.
Applicants should be aware that actual or perceived conflicts of interest will need to be managed appropriately and in accordance with all relevant legislation.
Time commitment and payment
Rules Committee members are expected to devote such time as is necessary for the proper performance of their duties. This will include attendance at on average four meetings per calendar year (usually in person), as well as consideration of occasional matters arising outside of these meetings. In addition, members will be required to consider all relevant papers before each meeting. Unless urgent and unavoidable circumstances prevent members from doing so, it is expected that members will attend all meetings outlined in this paragraph.
The appointment will be for a fixed period of up to 3 years subject to the terms of a contract, with provision for extension for up to two further terms.
Rules Section members are paid a set fee of £250 for attendance at each formal meeting. In addition, travel expenses may be reclaimed in line with the BHA Expenses Policy.
